**Line Manager**: Human Resources Executive

**Job Specification**:
**Key Performance Areas**
- ** Handling of Disciplinary Processes**
- Advise and consult on employee relations issues to management
- Enable and improve line capacity and effectiveness in employee relations matters
- Inform and advise stakeholders of case law updates and legislative changes
- Build industrial and employee relations capability at the Business Unit level to ensure the HR team and line managers are well-equipped to manage all misconduct matters
- Assist management to comply with all procedures on disciplinary enquiries
- Ensure that all line managers have the relevant employee relations manuals, reports and updates
- Attend to all day-to-day queries from stores on misconduct matters
- Ensure full compliance with the Labour Relations Act, as amended
- Ensure proper handling of all labour disputes referred to the CCMA, including preparation of bundles of evidence, preparing witnesses, and leading conciliation and arbitration processes
- Ensure proper handling of all labour disputes referred to the Labour Court, including briefing attorneys
- ** Handling of Poor Performance Processes**
- Advise and consult on poor performance process issues to management
- Inform and advise stakeholders of case law updates and legislative changes
- Build capability to ensure HR team and line managers are well equipped to manage all poor performance matters
- Assist management to comply with all procedures on performance improvement plans and holding of poor performance hearings, where necessary
- Ensure that the Spitz Poor Performance Management Procedure remains updated and available
- Attend to all day-to-day queries from stores on poor performance matters
- Ensure proper handling of all labour disputes referred to the CCMA, including preparation of bundles of evidence, preparing witnesses, and leading conciliation and arbitration processes
- Ensure proper handling of all labour disputes referred to the Labour Court, including briefing attorneys
- ** Handling of Incapacity (Ill-health/injury) Processes**
- Advise and consult on potential incapacity (ill health/injury) issues to management
- Inform and advise stakeholders of case law updates and legislative changes
- Builds capability to ensure HR team are well equipped to manage all incapacity matters and understand the claims processes for temporary and permanent disability benefits from the relevant funds
- Assist management to comply with all procedures on incapacity
- Maintain close relationship with Benefits Team to process disability claims and death claims efficiently and within set time frames
- Attend to all day-to-day queries from stores on potential incapacity matters
- Distribute information to the Business on the Employee Wellness Program and the offerings available through ICAS, as well as setting up employer referrals to ICAS, and Group Trauma Interventions
- Ensure proper handling of all labour disputes referred to the CCMA, including preparation of bundles of evidence, preparing witnesses, and leading conciliation and arbitration processes
- Ensure proper handling of all labour disputes referred to the Labour Court, including briefing attorneys
- ** Assistance with Retrenchment Processes**
- Assist with all restructures, employee redeployments and retrenchments in terms of the LRA, including preparation of first consultation notices, leading consultation process with affected employees, communicating final decision taken, and processing redeployments and terminations, where unavoidable
- ** Handling of Grievance Processes**
- Provide guidance on grievance matters with an intention to expeditiously and practically resolve grievances
- Ensure Spitz Grievance Procedure is kept updated and available to all employees, whilst driving compliance with the Procedure
- ** Support during Wage Negotiation Processes**
- Support HR Executive at wage negotiations with the Union, including establishing the mandate, participating in wage negotiations and ensuring feedback to the business
- Drive the building of sound relationships and communication with the union
- Represent the business and participate actively in general consultations and negotiations with the union and bargaining unit, dealing with all industrial action-related matters

**Minimum Requirements**:
**Experience**:

- A qualified attorney with at least 2 years of post-article practical experience

**Qualifications**:

- LLB degree

**Additional Requirements**:

- Knowledge of Labour legislation
- Knowledge of handling matters on workplace misconduct, poor performance, incapacity
- Knowledge of s189 and s189A retrenchment processes
- Knowledge of CCMA rules and proceedings
