Job Summary
We are seeking a highly skilled Senior Legal Officer to join our team at the Motor Industry Bargaining Council. The successful candidate will be responsible for coordinating and managing the legal process related to the enforcement of collective agreements in the region.
Key Responsibilities
- Coordinate and manage the legal process with regard to the enforcement of collective agreements in the region.
- Manage claims instituted against an establishment as a result of legal action.
- Prepare case files for hearings, attend conciliation and arbitration hearings, and present the council's case to ensure the collective agreement is maintained.
- Manage quality control of legal activities in a region.
- Manage external legal service providers and monitor compliance with the council's standard operating procedures.
- Assist with other functions as per the manager's instruction.
- Filing variation applications where commissioners' errors occur on arbitration awards.
- Interpretation of awards.
- Opposing rescission applications and filing notices with the DRC.
- Verifying and withdrawing finalized cases in the legal process.
- Referring unpaid settlement agreements as per Section 142 process/negotiating and finalizing administrative settlements.
- Compile and draft heads of arguments and applications.
- Attend monthly regional board meetings.
- Compiling legal recommendations to the regional council.
- Assessing provident fund exemption applications.
Requirements
- 2-3 years' experience in the field of labour law.
- Knowledge specifically with regards to bargaining councils and collective agreements.
- At least 1-2 years' knowledge and experience of the dispute resolution and LRA within a bargaining council environment.
- Knowledge of the civil procedure.
- Staff management experience.
- Ability to compile legal statistical reports for agenda submissions.
- Ability to interpret and apply/enforce the Mibco agreements.
- Above-average verbal and written communication and listening skills.
- Ability to build strong, effective relationships with all stakeholders, i.e., existing clients and potential clients as well as internal stakeholders, i.e., colleagues and management.
- Good decision-making and problem-solving skills.
- Good analytical skills with attention to detail.
- Strong negotiation and report-writing skills.
- Excellent administration skills.

Qualifications
- 4-year law degree from a recognized tertiary institution.
- Admitted attorney.
- Proven history of profit and loss management to maximize financial performance.
- Strong project management and multi-tasking skills.
- Knowledge of Microsoft Office Suite, particularly Excel.
- Computer literacy (Ms Office suite – Word, Excel, PowerPoint).
- Valid unendorsed driver's license.
