**_ Position Purpose:_**
To provide professional and effective legal advice and support on Business Risk & Legal functionality for all stakeholders on
general Litigation, labour law and Legal Risk issues, while ensuring adherence to relevant Corporate Governance structures
and processes.
**_ Position outputs:_**
1. Deliver professional services in the areas of:
defending all litigation, evaluating the merits of different matters by analysing all the available evidence to determine the
- prospects of success
- Drafting - drafting of all particulars of claims, pleadings, opinions and advice on evidence for TPT litigation matters
- Conducting legal risk assessments on litigation matters
- Labour - advising on labour processes and policy, coordinating arbitrations, training to terminals on labour law requirements
- Attending all High Court, Labour Court and Admiralty Court hearings to ensure implementation of instructions and to give
instructions during trial proceedings
- Legal Compliance (interpretation, opinions and policy commentary)
- Advisory Services
- Legal due diligences
2. Develop framework to proactively manage the implementation of the general litigation and labour law strategy for TPT.
3. Implementation of legal services framework and compliance to the Transnet Legal framework, policies, procedures,
uniform norms and standards
4. Identifies and mitigates litigation and labour law legal risks and exposures
5. Provides training and on-going development across TPT and implementation of training material to improve knowledge of
litigation and labour law.
6. Prepare, analyse, comment and interpret legal documents
7. Timeous and quality reporting for all management reports.
8. Analysis of root causes for matters to prevent future disputes and implement changes across TPT.
9. Engage with internal stakeholders from all the terminals and HQ on an ongoing basis to assist with Legal (including
Employee Relations) related queries.
10. TPT legal representative on the following forums:
- TPT Governance Committees, including TPT Riskco where litigation and labour matters are discussed;
- TPT HR Committees
**_Qualifications & Experience:_**
- Law degree or LLB with admission as an attorney or advocate
- 6 to 8 years post qualification experience in managing a litigation practice and providing professional advice in maritime,
labour and administrative law with good drafting skills.
- Membership of professional body (Law Society of SA)
Preferable: A relevant law degree and admission as an attorney or an advocate with 8 years experience in maritime litigation
and/or in a high risk operational environment. An appropriate business qualification would be a recommendation.
