-To serve as General Counsel providing legal services to the SARB Group and provide strategic direction and overall leadership to the Legal Services Department of the South African Reserve Bank (SARB) as Head of Department.
-Detailed Description
The SARB General Counsel is expected to be an authority on core legislation of relevance to the SARB such as the SARB Act, the Financial Sector Regulation Act, Insurance Act and various other legislation overseen by the SARB Group.
- Develop the strategy and policies of the Legal Services Department (LSD), aligned to the SARB strategy and ensuring common understanding amongst management and employees on the objectives, thereby ensuring strategically aligned legal services and support to the SARB Group.
- Serve as General Counsel on relevant forums, including but not limited to, SARB Board, Governors’ Executive Committee and Risk Management Committee (RMC).
- Manage the value chain, structure and resources required to deliver on the objectives of the LSD.
- Define and overseeing the implementation of the SARB’s legal systems and relevant frameworks.
- Create and drives a healthy work climate where employees are adequately motivated and empowered.
- Manages the performance and development of staff in the LSD.
- Oversee talent management including identifying appropriate talent in key positions, succession management and retention of key talent within the LSD.
- Provide high-level legal advice to the SARB Board, Governors’ Executive Committee, and top management to ensure that decisions taken are legally correct and that the SARB Group’s interests are protected.
- Represent the SARB Group on litigation matters with high reputational and financial impact to ensure that its interests are effectively safeguarded and that it can execute effectively on its constitutional mandate.
- Manage key internal and external stakeholders and representing the SARB Group at meetings with relevant bodies to ensure that the legal aspects of decisions are fully considered.
- Oversee the development and management of the annual budget for the LSD and ensuring that appropriate financial controls are in place.
- Oversee the preparation of management information and reports e.g. on legal risk management, litigation, external legal panel relationships and instruction allocation.
- Oversee the execution of the Over-the-Counter Share Transfer system with reference to the trading in SARB shares
- Oversee the execution of the contracts management system in the SARB Group.
- Oversee the tracking of, and internal and external engagement on relevant new legislative developments.
- Provide assurance to the Executive in respect of legal risk management processes in the SARB Group.
- Keep abreast with the local and global developments in the legal field which might affect the SARB Group.
Job Requirements
A Masters Degree in Law or equivalent qualification plus admission as an Advocate/Attorney.
- A minimum of 12 - 15 years of experience in Legal Services and Advocacy, with at least five (5) years in general management.
