Reporting to: Manager Employee Relations

Primary Function of Role: To provide an Employee Relations service in order to assist and equip Line Management, HR Management and employees and to offer support to ensure the ER is performed within the relevant and applicable Labour Legislation and company policies and procedures.

Principal Accountabilities:
To manage all disciplinary and grievance cases in order to ensure efficient case management:

- Chair internal grievance hearings, excluding Senior Management and executives
- Monitor disciplinary hearings and suspensions depending on case circumstances
- Represent the company at the CCMA and any other 3rd party for all disputes
- Brief Attorneys and Senior Council to represent the company when necessary eg. labour disputes, arbitration etc.
- Resolve all cases at the lowest possible level and escalate if needed

To provide an advisory service to management in order to coach and guide them in ER matters:

- Assist managers in compiling charges for disciplinary hearings
- Coach and guide Line Managers to present disciplinary hearings, grievances and disputes
- Identify needs of managers, i.e. training needs, knowledge of collective agreements and bargaining agreements
- Provide training on basic Labour Law, company policies and procedures in line with best practice

To assist the manager with regards administration for the department in order to ensure accurate and efficient arrangements and recordkeeping are maintained:

- Compile reports and update case records in conjunction with the ER Administrator
- Act as custodian of internal policy, assist in the formation of internal policy
- Assist in the preparation for meetings and negotiations
- Chairing of union and management meetings

To keep abreast of all relevant legislation and relgulations in order to maintain a current working knowledge
- Keep abreast of Labour legislation, best employment practices e.g. policies and procedures
- Update all relevant policies and procedures in the company and do research on employment and case law
- Advise and keep management abreast of all labour legislations updates as well as best employment practices
- Adhere to all Collective Bargaining agreements, and all policies and legislation
- Research legislation or practice as needed to support negotiations and cases, especially previous case precedents
- Monitor adherence to policy and legislation and escalate problems

To measure an monitor the ER needs within the company in order to offer support where required:

- Identify ER training needs for Line and HR Management and identify relevant training programs to meet the needs.
- Monitor support and guide Team Leaders and Managers during Picketing and strike actions
- Monitor all Union representative appointments to ensure that a free and fair process has taken place

All technical departments, All Line Managers, All staff

External:
Attorneys, CCMA, Labour Court

Problem Solving:
Chair all internal grievance hearings

Monitoring of disciplinary hearings and suspensions

Represent the company at the CCMA and any other 3rd party disputes

Prepare/consult with witnesses in preparation of CCMA cases and gather any relevant evidence

ER case management

**Inherent Requirements**

**Education**:
NQF 7 - Labor Law/Industrial Relations/Labour Relations ESSENTIAL

Knowledge of Labour/Employment ESSENTIAL

Have have a valid driver's licence (code 08) and motor vehicle ESSENTIAL

**Experience**:
6+ years HR Experience ESSENTIAL - Any industry

3+ years Employee Relations/IR experience ESSENTIAL - any industry but aviation industry will be an added advantage

2+ years understanding of CCMA case management - ESSENTIAL

2+ years Computer literate (MS Office) - ability to construct effective presentations/management reports - ESSENTIAL

Knowledge:
Employment Equity Act and related regulations - intermediate level

BBBEE regulations and related info - intermediate level

HR Policies, Practice and procedures - intermediate level

Employment Equity strategy development - intermediate level

Other workplace legislative acts - intermediate level

Constitution
- intermediate level
