**Case Assessment and Investigation**
- Conduct initial case investigation to determine if enough evidence exists to defend a potential or existing suit
- Engage in pre-litigation settlement discussions to attempt to resolve matters
- Drafting, reviewing, and negotiating a diverse range of agreements, and file comprehensive complaints and airtight responses
- Work closely with relevant stakeholders to prepare comprehensive briefs and motions on each case that goes to trial
- Interface with clients about discovery, depositions, trial preparation, and other case-related work
- Make frequent court appearances, hearings, and pre-trial conferences
- Advise business partners on the admissibility of evidence
- Assist the Investigators in terms of assessing and validating the Company’s case
**Manage the discovery process**
- Conducting in-depth research and analysis of all assigned cases.
- Manage the end-to-end litigation process.
- Conduct depositions; perform industry research on legal matters related to specific matters, as well applicable legislation
- Collect, process and analyse information gathered engaging with SME’s where required
**Conduct pre-trial activities**
- Review of all summonses and the subsequent actions relating thereto.
- Consult with clients, retain expert witnesses, attend pre-trial and develop trial strategies based on facts and evidence
- Draft and argue pre-trial motions
- Prepare witnesses and clients for testimony
- Develop effective strategies to defend cases in court
- Maintains comprehensive case files to a high professional standard
- Attend bail hearings emanating from employees’ arrest during the course of their employment
- Assist external legal counsel with regards to trial preparation in the Regional and High Court when required
**Drafting of legal documents**
- Draft pretrial motions, including motions to strike or dismiss evidence
- Draft pleadings to provide clear motivation justification
**Assisting IR on labour related issues**
- Monitor legal risk in documentation and give guidance on the acceptable assumption of risk
- Provide legal guidance at arbitration or mediation when required
- Engage with council on complex matters
- Interpret laws and help business partners/employees to understand legal options
- Review of arbitration awards
**Establish and maintain collaborative partnerships and a wide relationship network across business units**
- Implements a strong collaborative work-ethic with the team and with partners externally, providing support to and seeking support from business partners when necessary
- Building and maintaining relationships with internal and external stakeholders such as SAPS
- Develop legal networks
- Keeps Head of Legal and Compliance abreast of developments ad risks as they occur

**Minimum Requirements: Work Experience**
- 5 years labour or litigation experience with focus on criminal law, post admittance as an attorney
- Exposure to civil law (advantageous)
- Sound understanding of the CCMA process.
- Strong legal writing
- Knowledge of the legal principles that govern the Employer/Employee relationship
- Firm understanding of the rules, laws and regulations impacting SBV
**Minimum Requirements: Education**
- Bachelors in Law
**Special Training**
- Admitted attorney
**Function Competencies Required**
- Driver’s license with own vehicle
- Willingness to travel nationally at short notice
- Fully acquainted with regulatory and legislative compliance
