Job Description

The organisation operates in a highly regulated and competitive environment. A key responsibility is of the role is setting strategy to ensure overall compliance with all data protection legislation in the African markets that Experian operates in.

The General Counsel provides collaborative strategic legal advice on all aspects of operational and strategic issues, covering governance, corporate and institutional legal matters. The successful incumbent will lead and ensure the efficient and effective management of the Legal and Data Privacy team. The General Counsel works closely with other senior executives to ensure effective communication and information flow that facilitates smooth and predictable decision-making.

Qualifications
- Bachelor’s Degree in Law
- Admitted Attorney
- 10 years post articles experience
- Chartered Company Secretary with a CSSA qualification (desirable)
- A minimum of 5 years regulatory experience
- Experience within the Credit Industry and cross border legal functioning
- Experience in NCA, POPIA, PAIA, CBA, Companies’ Act and data privacy legislation
- Experience in M&A transactions - 5 years
- Experience in working in a matrix organisation
- Minimum of 5 years’ experience in a leadership role

**What you'll be doing**
- Oversee the day-to-day legal support and data protection legislations
- Ensure that the legal department has the appropriate processes in place to ensure that the business operates within the law.
- Offer counsel on legal issues and act as an effective guardian of the business
- Act as company secretary to ensure proper governance of Experian Africa.
- Ensure effective management of M&A activities from a legal perspective
- Develop BBBEE strategy and oversee the implementation of the strategy including managing of BBBEE audits.
- Provide expert and strategic legal advice to management
- Preparing, drafting and vetting of strategic legal documents that minimize risks and maximize legal rights;
- Set internal governance policies and processes for the business and manage the impact of external factors
- Conduct negotiations on behalf of the business on matters associated with the law;
- Managing and interface with third party legal advisors
- Advising all business units on crucial and material contractual issues, regulations and legal provisions;
- Providing and interpret legal information, conduct training and disseminate appropriate legal requirements to employees;
- Deal with complex, significant matters that cut across legal and related areas;
- Attract, develop, direct, motivate and drive performance in the team;
- Create associations of trust and respect with key stakeholders;
- Evaluate and weigh multiple inputs and impacts of any decision or course of action from a legal point of view;
- Ensure effective processes and systems for the execution of contracts and other legal documents by authorised signatories and that complete and accurate copies of contract documentation are kept and are accessible;
- Develop a corporate legal strategy that promotes and protects organisational interests;
- Develop the organisation’s legal knowledge management and horizon-scanning capabilities;
- Provide high quality legal and commercial input to the deliberations of the executive meetings;
- Coordinate the business’s response to litigation or any potential legal challenges;
- Oversight and management of external legal advisers ensuring delivery and value for money
