**_ Position Purpose:_**
- Safeguarding Transnet’s interests and reputation by protecting the organisation from undue liability through the provision of

professional and expert legal services and advice through effective prosecution and civil recovery litigation
- Leading and guiding the development, implementation and management of legal strategies that support the effective

prosecution of forensic and SIU (Special Investigative Unit) reports and limit corrupt practices in Transnet
- Managing the effective implementation of the approved strategic business plan, goals and objectives to ensure the

achievement of overall key labour law and civil recoveries litigation outputs across Transnet.
- Providing strategic leadership and guidance in the delivery and management of labour law and civil recovery litigation

across Transnet in terms of the applicable statutes and rules of the courts
**_ Position outputs:_**
- Provide leadership and advice in the provision of labour law litigation services to Transnet business, Operating Divisions and

subsidiaries in order to minimise legal and compliance risks, provide professional legal counsel, and advise on litigation as

appropriate
- Provide assurance to the Transnet Executives that the Company’s labour law litigation as well as civil litigation recoveries

are properly managed
- Provide legal guidance and advice as and when required to Transnet Executives on labour law and civil recovery related

matters
- Identify, select and retain external counsel as required to handle litigation based on Transnet’s requirements, and oversee

legal services provided where required
- Ensure mitigation of legal risk exposure in all litigation through expert and professional legal knowledge and advice on

labour law and civil recoveries litigation
- Assist in providing strategic direction in respect of all civil recoveries of Transnet where wrong-doing is identified
- Ensure organisational compliance with prevailing statutory and regulatory requirements of all labour laws, and oversee the

implementation of changes in legislation and regulation within the organisation
- Oversee labour law litigation and substantial civil recoveries on referral from the Special Investigative Unit across Transnet

and Transnet Group Forensics.
- Engage with relevant stakeholders, intermediaries, law enforcement agencies and legal institutions when required
- Ensure interface and sharing of lessons learnt with People Management, Employee Relations and Forensics
- Ensure seamless and efficient civil recoveries against Transnet employees and third parties where wrong-doing and losses

to Transnet have been identified
- Ensure that work is secured and delivered in accordance with the defined ethics and values of the Group
- Analyse, assess and review forensic investigation reports, provide advice and recommend implementation strategy to the

General Manager and to business units where required
- Promote collaboration between the Labour Law Department, Forensics and Employee Relations Departments across

Transnet to ensure consistency and effective management of labour law disputes across the organisation.
**_ Qualifications & Experience:_**
- LLB degree with minimum 10 to 12 years’ experience in legal, labour law and litigation in a large organisation with complex
- operations, of which at least 3 - 5 years as a senior labour lawyer- Admission as an Attorney of the High Court or an Advocate at the Bar
- Professional with advanced knowledge of Labour law
- Experience in advising on major labour law issues for large and complex organisations
- Requirement of trust and honesty in the handling of finances as per the National Credit Act Amendment 1
- Standard Job Requirements:

- Local and international travel as required by the business
