Who are we?
Sanlam Developing Markets [SDM] (a wholly-owned subsidiary of Sanlam Life Limited) is one of the top financial services providers in the South African entry-level and emerging middle market. It aims to understand the unique requirements of clients and offers a wide range of simple and affordable financial solutions that cover needs such as funeral insurance, savings for education, life cover and personal accident plans. In terms of the Sanlam Group Governance Policy, SDM is managed by the SA Retail Mass cluster, which is part of the Sanlam Life and Savings cluster within the Sanlam Group. The cluster focusses on retail products, as well as group schemes. What will you do?
PURPOSE OF THE ROLE
To drive the mitigation of financial and reputational losses and enable the continuity of services provided by Sanlam Retail Mass (SRM) through:
Assuming overall accountability for the Enterprise’s compliance to regulatory, legislative and industry requirements.
Establishing and maintaining a legal strategy and framework for SRM, guiding the business through the intricacies surrounding new business models, partnerships, mergers, acquisitions and shareholding agreements across SRM. (providing input to legal documents / contracts / etc.).
Championing a complaints management strategy and framework that enables an optimal client experience.
This job incumbent will manage and oversee the Legal, Compliance and Complaints Department
KEY RESPONSIBILTIES
Set strategic direction for Legal, Compliance and Complaints Management
Work with the Chief Operating Officer and provide strategic input towards the formulation of the overall SRM Business Operations strategy.
Set and gain approval for the SRM Legal and Compliance strategy (including Complaints), business plans and metrics in line with external (Industry, Regulatory, Legislative) and internal (profitability, growth, client experience) targets.
Guide and approve the operationalisation of the SRM Legal and Compliance strategy, setting performance measurements along the legal and compliance value chains.
Oversee the development of frameworks for identifying, negotiating, agreeing and managing partnerships with external vendors and service providers in line with legal, procurement and compliance frameworks/requirements.
Drive the overall SRM Legal and Compliance budget. Be accountable for, and ensure Legal and Compliance Heads react to budgetary performance and business requirements and motivate recommendations/requests for further budget / deviation from budget where appropriate.
Remain up to date with advancements and developments in the technology / legal / regulatory landscape, best practice and competitor trends to make the department more cost effective. Guide and ensure the adoption of best practices to optimise SRM performance.
Serve on the Executive Committee.
Legal, compliance and complaints advisory
Provide guidance in the interpretation of legislation and impact thereof.
Provide legal and compliance support to the SRM Exco and the Board on all legal matters, legal structures pertaining to group schemes, new business ventures, and funeral parlours and any legal issue pertaining to the SRM business as a whole.
Provide direction, assurance and support to the SRM Exco on legal and compliance matters during acquiring of new business entities (Mergers & Acquisitions), formulation of partnership agreements, and development of unique business models.
Provide legal and technical advice relating to insurance products and new business ventures.
Be a point of contact between SRM and Industry role players, continuously interpreting and communicating requirements pertaining to licencing, compliance management, and complaints management practices. Key Responsibilities
Directing compliance frameworks and policies
Accountable for setting and leading the implementation of compliance policies, principles, standards and information flows to ensure SRM complies to Regulators (and regulatory requirements) and is able to maintain its licencing and relevant agreements.
Be the point of contact for all compliance matters and regularly engage with various regulators.
Work closely with the 2nd Line Compliance function to align / implement standards and mitigate compliance risks.
Provide guidance to the Board and Exco members on the interpretation of compliance legislation.
Guide the compilation of responses pertaining to queries received from the various regulators that should be resolved on Exco level.
Ensure alignment of systems, policies, standards, processes and controls implemented to monitor and measure compliance across all SRM Entities.
Drive the achievement of monthly and annual compliance targets for SRM.
