NBCRFLI - Logistics / Manufacturing Industry - East Rand

Job Purpose :

To ensure that processes and procedures in the Industrial Relations are adhered to on a company-wide level, minimizing risks to the business from a dispute resolution standpoint by ensuring that correct and consistent processes are maintained at all times. Training and development of internal management in IR processes. Representation and attendance at internal IR forums / proceedings, and external dispute resolution forums.

Minimum requirements :

  1. Minimum 5 years experience in an IR / ER management role in logistics / manufacturing industry
  2. LLB Degree (Admitted Attorney advantageous)
  3. Experience with 2000+ personnel
  4. Valid SA Drivers Licence
  5. Clear ITC and criminal record
  6. MS Office applications
  7. Must reside on the East Rand
  8. Extensive understanding and knowledge of labour legislation
  9. Extensive knowledge and experience of all CCMA / NBCRFLI

Salary offer : R70K per month

Responsibilities :

  1. Legal drafting of applications or notices to be used at CCMA, National Bargaining Council for the Road Freight and Logistics Industry (NBCRFLI) and / or Labour Court, such as condonation applications and rescission applications.
  2. Represent the company at all matters at the CCMA and NBCRFLI.
  3. Interacting with external legal counsel on any IR matter, including Labour Court.
  4. Training of line management in aspects of IR, including investigations and chairing of hearings.
  5. Drafting of monthly IR reports, including Board submissions as and when required.
  6. Drafting of written communication to any external parties, such as trade unions or attorneys, as and when required.
  7. Keeping the business up to date on amendments regarding labour related matters, such as developing cases, changes in legislation, strike action and wage negotiations.
  8. Providing an all-round comprehensive IR function to the business, thereby ensuring all IR / HR policies are complied with, including the compliance of such by line management and supervisors.
  9. Ensuring a comprehensive investigation of any misconduct, including attending to suspensions, issuing and drafting of notices of hearings and drafting of warnings or dismissal notices.
  10. Drive and manage misconduct, incapacity and retrenchment matters from start to finish in a timely manner, ensuring fairness.
  11. Manage matters relating to poor work performance, sick leave abuse and regular absenteeism.
  12. Acting as the IR Representative and being present in any IR matters such as disciplinary hearings, incapacity processes, counselling sessions and consultations.
  13. Ensuring that the correct IR processes are followed within the business, and ensuring all processes are fair, consistent and compliant with company policies and any governing legislation.
  14. Making certain that recordings are properly transcribed by typists / scribes.
  15. Immediately notifying the Payroll department of any terminations, suspensions and abscondments.
  16. Drafting and amending IR policies from time to time to ensure they are up to date.
  17. Draft and amend any agreement that may be required, such as settlement agreements, retrenchment agreements and mutual separation agreements.
  18. Liaising with Temporary Employment Services (TES) on IR matters concerning TES employees, including guidance on corrective action and correct processes.
  19. Travelling to the companys various branches for IR support to management, training, or representing the company at CCMA and NBCRFLI.
  20. Assisting the Group IR Manager with Employment Equity related matters from time to time.
  21. Assisting the Group IR Manager with any trade union engagement or interaction.
  22. Any additional or ad-hoc duties and responsibilities related to the position which may be requested by management.
