Role Overview:

This role will be responsible for providing legal services and advice to the Sybrin Group of Companies. This covers various aspects, such as contracting, legal opinions, company secretarial, data protection, trademark registration, BEE audit, company policies, and debt collection.

Qualifications and Experience:

1. Minimum of 8-10 years' experience
2. Bachelor's degree – LLB
3. Knowledge of ISO 9001 and ISO 27001 standards
4. Knowledge of GDPR

1. Deliver legal advice across a variety of legal topics, including contract law, intellectual property rights protection and ownership, labour law, corporate governance, and data protection.
2. Draft, vet, and negotiate supplier agreements, software licensing agreements, software development agreements, partner agreements, reseller agreements, teaming agreements, service level agreements, implementation agreements, data protection agreements, non-disclosure agreements (NDA), and property lease agreements.
3. Ensure ongoing POPIA compliance.
4. Appointed PAIA Information Officer (Promotion of Access to Information Act).
5. Coordinate with external attorneys to manage litigation matters and trademark registrations.
6. Handle shareholder inquiries regarding corporate governance.
7. Company secretarial matters, such as drafting resolutions and board meeting minutes, director changes, updating internal databases, and filing annual returns with the CIPC.
8. Drafting and vetting of company policies.
9. Assist with B-BBEE compliance and audits.
10. Exchange Control application and compliance with regulations.
11. Conduct risk assessments and data protection impact assessments (DPIAs) as necessary for high-risk processing activities.
12. Implement data breach response protocols, managing incidents, and ensuring timely notification and resolution of breaches.
13. Develop, implement, and enforce policies and procedures for data protection compliance across the organization.
14. Monitor ongoing compliance with relevant data protection laws and regulations, including GDPR, or other applicable standards.
15. Work closely with other departments to align data privacy and security strategies.
16. Advise on data protection implications of new projects, services, or initiatives and ensure data privacy is integrated from the outset.

1. Junior Legal Advisor reports into this role.
2. Direct report into CFO.
3. Data Protection report into CEO.
