Policy & Regulatory Support

  • Develop and maintain a regulatory reporting framework to ensure that TMSA complies to all relevant legislation, regulations and rules which govern related operations (e.g. Petroleum Products Act, Petroleum Pipelines Act, Petroleum Pipelines Levies Act, Ports Act).
  • To conduct analysis which assists TMSA in assessing the impact of policies and regulations on the TMSA business.
  • To assist the company in developing strategic direction, together with relevant internal stakeholders in response to policies and regulations.
  • Coordinate input from relevant Business Units (Line Function) to ensure that TMSA's position is established, wellarticulated and communicated in response to proposed policies, legislation, regulations and rules as well amendments to any of the aforementioned.
  • Provide support and advice to the business in preparing (periodic and ad hoc) reports to be submitted to Regulators

Manage and execute Petroleum Audits, Applications and Reporting

  • Manage the end to end process for the annual petroleum Regulatory audits
  • Compile the annual RAS template and ensure that the audits are conducted as per published Regulatory Reporting Manuals
  • Work with business units to ensure that no significant audit findings arise and that there are no recurrent audit queries.
  • Recommend Regulatory Audit Report for sign off
  • Ensure compliance with NERSA RRM requirements

Coordinate Regulatory Audit Process

  • Provide support to ensure that the Regulatory Audits are conducted and relevant input is provided by all relevant business units
  • Ensure that accurate and verifiable information is provided by relevant business units to Auditors

Conduct Analysis to inform Margin and Tariff Applications

  • Together with Corporate Strategy and Planning Division and relevant Business Units:
  • Analyse business impact of new legislation / regulations or amendments
  • Analyse the business impacts of changes in Regulatory Accounting and Tariff Methodologies
  • Make recommendations to business and management informed by analyses.

Communication & Reporting

  • Establish and participate in the internal regulatory forum which enables coordinated feedback from and to relevant external forums (e.g. Government, NERSA, SAPIA) by business units and TMSA.
  • To ensure communication of all regulatory reporting timeframes to Management
  • Monitor and communicate all public notices from government and regulators which require industry or TMSA response
  • Share Business Intelligence pertaining to applicable Policies and Regulations with the business
  • AFA updates, Board quarterly updates

Stakeholder Relations

  • Represent the company and provide feedback to Management from all public hearings and external forums to inform appropriate response and policy position by TMSA.
  • Participate in specialist teams required for tasks and studies relating to regulatory matters or policies as and when necessary.
  • Maintain a Regulatory Stakeholders and issues matrix.
  • To promote, support and represent the company's interests at all relevant industry and government forums (e.g. Government Departments, Regulators, State Owned Companies, SAPIA) for TMSA including the NBS affiliates.
  • Facilitate interactions when required, between relevant business units and local authorities where TMSA has operational facilities.
  • Establish and maintain strategic relationship with key stakeholders such as DMRE, NERSA, Transnet Pipelines, Ports Authority and SAPIA
  • Manage the SAPIA Sub-Committee Representation & participation

Context and environment

  • The South African Petroleum sector is highly regulated with an evolving policy framework. Over the past few years, the petroleum industry has been evolving with many new nonintegrated companies entering the market. As a result, the petroleum industry has become quite diverse with the spectrum of the interests of different players increasing. As a consequence, different polices, regulations and rules have a very divergent impact on different players within the market. In parallel, in order to create a climate of inclusivity, industry associations that exclusively represent players from only a segment of a particular industry are frowned upon. Is has thus become increasingly important for companies to clearly establish their individual positions on policy and regulatory matters and elevate their voice and make clear such individual position to regulatory authorities.
