Legal Commercial/ Claim Manager

Summary

Contract Position - 12 Months

As a Legal Commercial / Claim Manager, you will be responsible for handling EPC construction claims identification, avoidance, defence, and prosecution.

  • Manage all legal matters on the Project.
  • Act as a central point of contact for claims and disputes, overseeing the resolution process.
  • Conduct analysis and assessment of unresolved claims at the project level, considering both contractual and legal aspects to identify relevant facts and records.
  • Gather and analyze information based on facts, records, and contractual agreements.
  • Develop strategies for claim resolution, defenses, and counterclaims.
  • Generate reports and recommendations related to claims and disputes, evaluating the magnitude of the issues.
  • Handle delay analysis processes for all planning/time components of claims, offering suitable methods for delay and program analysis.
  • Examine construction programs to evaluate entitlements accurately.
  • Offer substantiation and guidance on all claims.
  • Produce concise, well-written reports and letters that require minimal revisions.
  • Provide advice and assistance to Company Contracts Directorate departments regarding disputes.
  • Contribute the commercial perspective to the client's decision-making process concerning disputes and litigation.
  • Support the team with contractor's applications, certifications, variations, and claims.
  • Follow and stay informed about procedures related to Contract Administration, Claims Management, Employer's Claims, and Contractor's Document Inspections.
  • Deliver independent conclusions and recommendations.
  • Offer guidance on potentially contentious matters related to the project and evaluate claims.
  • Identify and assess key records and facts, determining contractual and legal entitlements for all parties, advising on claim resolution, defense strategy, and program analysis, as well as evaluating the magnitude of the claims.
  • Manage disputes, ensuring thorough consideration of contractual, factual, and commercial aspects.
  • Collaborate closely with Contracts Directorate to diagnose contractor's exposure accurately, report it effectively, and mitigate risks when necessary.

Minimum Requirements

  • Degree in law
  • At least 10 years' experience in handling and managing claims and disputes on significant infrastructure projects.
  • Extensive expertise in working with FIDIC, NEC, and GCC suite of contracts.
  • Varied experience in different roles within the construction industry, including positions with clients and contractors/subcontractors.
