*Job Description*
The Legal Litigations Manager is responsible for the strategic direction, oversight, and hands-on management of all legal disputes and litigation matters arising from MiWay Claims department. This includes managing a portfolio of active legal claims, driving an effective legal defense strategy, ensuring compliance with civil procedure and regulatory frameworks, and controlling external legal spend. The role is critical in mitigating legal risk and ensuring fair, legally sound outcomes.

*Minimum Qualification Required*

  • LLB Degree (NQF Level 8)
  • Must be an Admitted Attorney of the High Court of South Africa.

*Minimum Experience*

  • Minimum 4 years' post-admission experience in a Law Practice.

*Key Responsibilities*

  • Litigation Management and Strategy: Manage and direct the full litigation portfolio across all classes (motor, non-motor, specialist claims), ensuring the development and execution of robust legal defense strategies.
  • Attorney Oversight: Appoint Engage with external panel attorneys, ensuring adherence to Service Level Agreements (SLAs), quality standards, and strict legal cost containment.
  • Expert Legal Advice: Provide expert, timely legal opinions and guidance to the Claims team and senior management on complex, high-value, or sensitive claims with potential for litigation or high reputational risk.
  • Compliance and Governance: Ensure strict adherence to the Rules of Court, relevant civil procedure legislation, the Insurance Act, Policyholder Protection Rules (PPRs), and internal legal governance frameworks.
  • Process Improvement: Drive strategic initiatives to standardize and improve the efficiency of the legal claims management process, including the digitization of legal data and reporting.
  • Stakeholder Management: Effectively manage relationships with internal claims handlers, external legal counsel, and third-party stakeholders.
  • People Leadership: Lead and support the development of any internal legal staff.

  • Expert knowledge of the litigation process in South Africa.
  • In-depth technical understanding of the short-term insurance industry, policy wordings, and the South African regulatory landscape.
  • Exceptional legal drafting, interpretation, negotiation, and mediation skills.
  • Strong financial acumen relating to legal cost management, budgeting, and claims reserving.
  • High-level communication and presentation skills, capable of explaining complex legal issues to non-legal stakeholders.
  • Advanced conflict resolution and escalated complaint handling skills, particularly those involving legal challenge
