Dispute Resolution Clerk

To administer the resolution of disputes emanating from the furniture manufacturing industry in accordance with legislation and CCMA rules.
Engage with applicant to complete referral forms (LR7.11) through one-on-one consultation and explain process and what proof of service is required to serve on the company
Receive proof of service and hand over to Dispute Resolution Officer to allocate dates and times for conciliation
Capture case on the CCMA case management system to generate case number and receive allocated case time
Schedule the case as per date and time, print notice and serve on applicant and the company
On the conciliation day prepare documentation (certificate of outcome, attendance register and settlement agreement) for the Conciliator
If conciliation is settled, receive file, capture outcome on the system and close the file
If the matter is unresolved, complete arbitration referral form in consultation with the applicant to serve on the company
Receive proof of service and contact panel ofCommissioner to determine availability, and schedule the matter for arbitration
Contact interpreters and invite to attend the arbitration
Print the notice and serve on both parties
On the arbitration day, receive settlement agreement, capture outcome on system and close file
If not settled, capture outcome onto the system as per the arbitration award and serve on the parties and close case on the system
Prepare monthly reports on case statistics for submission to Council for interest and rights disputes
Prepare CCMA quarterly reports on case statistics received, scheduled, arbitrated or referred - CCMA
Allocate case number for files and prepare notices to be served on the companies
Schedule all matters
Monitor the delivery of proof of services from the Inspectorate Department within the allocated time frame for interest and rights disputes
Once noticed is served, hand over file to be prepared for arbitration by an alternative Disputes Resolution Clerk and check when company has paid from compliance order to date of arbitration; if payment received for that period, send out withdrawal notice to the company
Capture outcome following arbitration and serve arbitration awards on the establishment
check fr compliance prior to filing the matter with the CCMA
hand ver the certified award received from the CCMA to the Supervisor Check accuracy of calculations and compliance of the contributions / returns submitted and reconcile
payments made by the establishment
Check adherence to arrangements as per the award and liaise with the company to enforce payment for any payment defaults
Grade 12
