Lead Legal Counsel

The main purpose of this position is to provide comprehensive and effective legal support to the South African Reserve Bank (SARB) and its subsidiaries (collectively the SARB Group) in the field of commercial law, with a specific focus on (i) corporate real estate entailing, among other things, engineering and construction contracts as envisaged in guidelines to the _Construction Industry Development Board Act _38 of 2000 (CIDB Act) such as the International Federation of Consulting Engineers (FIDIC) and the Joint Building Contracts Committee ( JBCC) contracts; also Professional Client/Consultant Services Agreements Committee (PROSCA) contracts; (ii) property, including sale and purchase, lease and refurbishment agreements; (iii) facilities and installations, including the supply and installation of equipment, power and water supply, minor works and maintenance; and (iv) safety, health and environmental (SHE) as well as general legal support to the Procurement Division. Detailed Description Negotiate, draft and vet various commercial contracts. - Identify, address and manage potential legal risks within the SARB Group. - Steer legal processes for internal clients on complex legal challenges and disputes affecting their operations. - Conduct research into a wide range of matters relating to corporate real estate and commercial, procurement and labour law. - Take responsibility for addressing issues pertaining to relevant legislation applicable to the SARB Group. - Review and draft policies for the SARB Group. - Establish processes to enhance efficiencies within the SARB Group. - Provide legal advice and opinions. - Represent the Legal Services Department (LSD) and the SARB Group on internal committees and/or forums. - Build and maintain relationships with internal and external stakeholders. Job Requirements have an LLB degree or an equivalent appropriate legal qualification; - be an admitted attorney or advocate, or be a corporate lawyer at a reputable legal practice or at a reputable technology or other corporate; and - have at least 7-10 years’ experience as a practising attorney, advocate or in-house legal counsel/corporate lawyer. The following would be an added advantage: - a solid record in leading and concluding complex legal projects; - experience in corporate real estate law; - exposure to construction projects; and - experience in employment and labour law (including litigation).
