Purpose

Our client leaders in the telecommunication sector is looking for a Legal Advisor to ensure that the company operates within legal parameters. To mitigate company risk and safeguard the company. To provide support to the Manger: Legal & Corporate, where required, to provide advice, instructions and assistance to management within business regarding legal matters, government regulations and legislation relating to the company’s business and ensure the legal department provides the required support to business, meets and exceeds business expectations, with a focus mainly on the Sales Department.

ACCOUNTABILITIES & RESPONSIBILITIES

Cultivate and manage objective working relationships with a variety of stakeholders, including Customers.
- Translate Sales Department and Legal Department strategies into actionable goals and execute relevant projects / initiatives aligned to strategic objectives with specific performance measures and control systems to track progress.
- Assist in leading legal projects that span legal, business and functional boundaries (e.g. Contract Management roll-out through various departments)

Assist the Manager: Legal & Corporate with ensuring the company complies with governance in terms of legislative and audit requirements.
- Assist the Manager: Legal & Corporate with identifying and communicating current and anticipated legal issues or risks.

Remain abreast of new legislation and industry best practice (RSA/International).
- Assist in reviewing the company’s compliance in respect of legislation.
- Inform relevant Management of the impact of legislation, as well as recommended action.
- Assist in developing and implementing compliance related campaigns in order to create awareness in relation to the importance of compliance as well as to provide staff with knowledge and skills related to compliance.

Assist in reviewing the company’s policies and codes in light of legislation and make recommendations.

Assist with ensuring compliance to internal codes and policies.
- Inform Management of the impact of the non adherence to policy and recommend action.
- Provide the monthly, as well as annual code of ethics and induction training.
- Provide guidance and clarity competently, as well as timeously on any internal policies and procedures which have a legal impact within the company

Assist mainly the various departments with the compilation and/or finalisation of tenders/bids/RFP/RFQ/RFI and related documents.
- Assist the Bid Office with reviewing the submitted tenders/bids/proposals/quotations and provide recommendations.
- Review and/or draft contracts, as well as legal related documents prior to company signatures for the Sales Department.
- Peruse legal related documents and provide advice on the risks, legal accuracy, applicability, etc. Propose and draft changes / alternatives to contracts for Sales Department mainly.
- Provide guidance on the obligations of the company and explain the meaning of provisions.
- Request feedback and/or confirmation where appropriate.

Update and return amended contracts to the Sales team for input.
- Inform the relevant stakeholders/departments of the impact of non-adherence to the contract or the company’s policies and recommend action.
- Ensure third parties are placed on terms if non compliant.

Oversee, when appropriate, that the contract register is updated and tracked monthly with the assistance of the Legal Administrator.
- Attend to the investigation of any breach relating to a contract or legal related document, discuss same with the Manager: Legal & Corporate and strategize on how best to respond.
- Liaise with external legal parties where relevant.

Supervise the vetting and/or accreditation of all new suppliers and ensuring that such suppliers have undergone an annual due diligence with the assistance of the Paralegal / Legal Administrator.
- Identify risks and issues, as well as suggest alternatives to derive the best solutions for the company.
- Investigate allegations of poor and/or unethical procurement best practices and report to the Manager: Legal & Corporate.

Provide input where required into the drafting of new policies, as per business end user or management requests when processes or legislation changes

Provide ad hoc advice on legal contracts from various departments.
- Preparation of advice based on research. Provide research and advice to Manager: Legal & Corporate and strategize on the way forward.
- Resolving issues through correspondence, telephonic discussions, verbal advice, etc.

**Knowledge, qualifications and experience**

LLB / related Legal Degree.
- Admitted Attorney of the High Court.
- Min 3 - 5 yrs corporate legal experience with strong drafting exposure, good negotiation skills and contract management.
- ICT industry experience preferable.
- Customer centricity with the ability to protect the company’s interests.
