  • Advising and educating individuals or organizations on acquiring and managing debt.
  • Providing guidance in determining the best type of loan and explaining loan requirements or restrictions.
  • Developing debt management plans, advising on credit issues, or providing budget, mortgage, and bankruptcy counselling.
  • Dealing with complex debt situations, helping people to manage their finances and eventually become debt free.
  • Providing practical help and advice to clients whose debts have got out of control, advising on issues such as financial planning, budgeting, money management and bankruptcy.
  • Reviewing clients' financial histories to assess their current situations from a debt perspective.
  • Offering advice and education on personal debtrelief strategies, such as implementing better budgeting tools, exploring the possibility of debt consolidation or seeking bankruptcy protection.

Responsibilities of Debt Counsellor on Record.

  • Issuing of Final Proposals
  • Updating and follow up on rejected and accepted proposals
  • Certify and signing of founding affidavits
  • Attend to Attorney queries and creditor's queries
  • Issuing of form 1
  • Request for Transfer

The Debt Counselling process

  • DC to issue Form 17.1 within 5 business days of acceptance
  • If no COB is received within 5 business days DC to issue Reg 24(4) Notice to CP's and accept info provided by the Consumer
  • COB balance is not updated during the Debt Review process. The aim of Debt Review is to repay COB value. End balances to be paid at the end of Debt
Review

  • Within 10 days of receiving COB the DC should complete the Affordability
Assessment and issue Form 17.2 and repayment proposal

  • When Form 17.2 is submitted the DC should also submit Debit Order
cancellation form per credit agreement to each Credit Provider

  • CP to respond to repayment proposal within 10 days of receiving proposal
  • DC to record CP response within 10 days of receiving proposal response and create summary repayment plan
  • DC to submit repayment plan to Magistrate Court indicating acceptances and nonacceptances
  • DC to submit repayment plan to PDA which includes cascading
