Job Summary:


JOB HOLDINGS (PTY) LTD is seeking a highly experienced Lead Attorney to provide an independent legal opinion reviewing a tender process.

The review will ensure compliance with the client's supply chain management policies and procedures, specifically focusing on legislation such as the MFMA, PPPFA, Municipal Systems Act, the Constitution of the Republic of South Africa, related regulations, and the Preferential Procurement Regulations of 2017.

The scope of the review will also encompass relevant legislation like the Company's Act, National Small Business Enterprise Act, and the National Small Business Support Strategy.


Key Responsibilities:

  • Conduct a thorough review and analysis of the tender process to ensure compliance with applicable legislation and regulations.
  • Assess the alignment of the tender process with the client's supply chain management policies and procedures.
  • Evaluate the tender process against the requirements of the MFMA, PPPFA, Municipal Systems Act, the Constitution of the Republic of South Africa, and related regulations.
  • Ensure compliance with the Preferential Procurement Regulations of 201
  • Consider additional relevant legislation, including the Company's Act, National Small Business Enterprise Act, and the National Small Business Support Strategy.
  • Provide a comprehensive and independent legal opinion detailing the findings of the review.
  • Identify any noncompliance issues and provide recommendations for corrective actions.
  • Liaise with relevant stakeholders to gather necessary information and clarify legal requirements.
  • Prepare and present detailed reports to the client's management and relevant committees.

Qualifications:

  • LLB degree or SAQA accredited law qualification
  • Minimum of 5 years of experience in legal practice, with a focus on supply chain management, procurement law, and public sector compliance.
  • Indepth knowledge of South African procurement laws and regulations, including MFMA, PPPFA, Municipal Systems Act, the Constitution, and related regulations.
  • Proven experience in providing legal opinions and compliance reviews.
  • Strong analytical and problemsolving skills.
  • Excellent written and verbal communication skills.
  • High level of integrity and ethical standards.
  • Ability to work independently and manage multiple tasks simultaneously.
  • Proficiency in legal research tools and software.

Preferred Skills:

  • Experience working with municipal and public sector entities.
  • Familiarity with the National Small Business Enterprise Act and the National Small Business Support Strategy.
  • Strong negotiation and stakeholder management skills.
